As a beginning mediator, I found this book very detailed and theoretical. I am sure that I will return to it again and again as I gain experience. I found "Basic Skills for the New Mediator (2d edition)" by Allan H. Goodman to provide a quicker and more practical overview. When used together, I believe both booksare a good basis for the practicing mediator.

First, let me confess a bias, which after all is no more than a leaning in a particular direction. When I first started in mediation, I listened to everyone who had anything to say about the subject. It wasn't long before I learned enough to be able to sort the wheat from the chaff. Time is fleeting and one doesn't want to spend too much of it chewing on the indigestible. So when I came across a person who talked sense first time, next time and all the time, I developed a leaning in his favor. Jeff Krivis talks sense - one reason is that he has mediated several thousand major cases. Another is that he is self-reflective; he thinks about what he is doing. A third is that he has never been afraid to be innovative. I learned this in informal seminar situations, but I learned it in aces and spades when, as a lawyer, I retained Krivis as mediator. That was a mediation to remember, particularly because it was preceded by no fewer than five unsuccessful mediations with other mediators, four of them retired judges. This book is a wonderful, comprehensive collection of essays covering a wide variety of topics integral to an understanding of the "art" of negotiation.As a litigator, I find myself spending a large amount of time in negotiations.I picked up this volume because it came highly recommended by a friend of mine who has been involved in the field of negotiations for several years now, and I can only echo my friend's recommendation.The book is organized into topical chapters, all of which can be read independently from one another and are written in a manner that makes the information, research and theories easily accessible even for relative newcomers to the field of negotiations.Most importantly, this book is geared towards giving readers not only the tools to become better negotiators, but also to explain why and how these tools are successful - information that I believe is critical to one's ability to effectively implement negotiating techniques based on the specific situations and people one encounters.Of particular interest to me were those chapters that deal with the more psychological aspects of negotiations, such as importance of gender, emotions, identity and culture; topics that are key to an understanding of interpersonal relationships and all too often are either ignored or only superficially touched upon.I highly recommend this book to everybody interested in educating themselves about the topic of negotiations - and becoming a better negotiator along the way.

I negotiate commercial transactions and related disputes for a living.I've been told (and I know) that my style can be abrasive and that the victories I get are at times only short-term in nature.Having heard this enough, I decided to try to educate myself on the topic.So I picked up this book because it looked the most authoritative and considered - I don't really go for those hokey "secrets to success" books; I think its important to understand a subject and draw your own conclusions, not be told what to do.Well, its fair to say this book had everything - interesting and relevant history on the topic, practical prescriptive advice, topical discussions about the roles of emotion, identity, agents, and analytics in negotiation and dispute resolution.I thought the introduction by the editors was a great guide, and I got a lot out of the chapters by Shapiro, Bazerman, Moffitt, Stone/Heen, and Peppet.I'm not sure if I've yet converted its teachings to "success," but I'm certainly better for it, and better informed.This is a great reference for anyone who encounters disputes for living, and that's pretty much everyone.

You don't generally think of books like this as "page-turners", but I could not put it down.In Extreme Facilitation, Suzanne Ghais has moved away from the cookbook (techniques-based) view of facilitation found in many other books and training materials, and has captured the core principles that underlie successful facilitation in extreme situations.For example -- there are no "difficult" people in a group; rather "difficult" behaviors reflect needs or interests that have not yet been identified or adequately addressed.Once these needs or interests are understood by the group and dealt with, the "difficulty" usually passes.

I often look at reviews for practical advice, i.e., if people like me read the book and get something out of it, then I want it. Well, as a trial lawyer and as someone who would benefit a lot from doing my best at mediation, Jeff Krivis' book is a DEFINITE READ. Mr. Krivis' style is clear and very easy to understand.After setting forth various fact patterns that an experienced lawyer might see, he shows how different approachs to meditation settle the case. This is a window into how to a top mediator thinks about your case and the strategies he uses to help both sides resolve their differences. What could be better?

I have been a full time mediator for seven years. Before that, I was a litigator. At times, I utilized Mr. Krivis' expertise as a mediator. I recall thinking: "This man's an alchemist. He settles all of my cases, but does so in a different way each time. He truly is an improvisational genius." Now, through his new book, Krivis gives me some insight into his practice. This book should be required reading for anyone currently mediating the litigated case. It should also be read by litigators. To litigate, negotiate, mediate, or arbitrate? That is the question.Unfortunately, unless you take advantage of a clinical program, law school does a pretty pathetic job of preparing you to litigate after graduation.However, whereas some attempt is actually made to teach law students something about litigation (see, e.g., courses in Civil Procedure, Evidence, and Legal Research and Writing), a minority of students receive exposure to alternative dispute resolution principles, which are increasing in popularity at courthouses nationwide.

After having to research different ADR textbooks, I found that this book gave a great balance of "soft" skills and the law that isn't found in the rest of the books.For those law students who are used to reading incredibly case-heavy texts, this book takes a bit getting used to and seems like there isn't much to it.In fact, the skills taught in the law review articles are what can make the difference between an effective and ineffective mediator.
