You can tell from the use of the debacle in the title that the authors evaluate the business effects of the Sarbanes-Oxley (SOX) regulations negatively.Their arguments are interesting and convincing.One of the great things about our system of government is that we can revisit excesses of the past and fix them over time.Butler and Ribstein take us through the climate that led to the enactment of this set of regulation and that was an over reaction to some large business failures.

Many people reading this book will be law students, but even for those who aren't, Kermit Hall's collection is a terrific resource for readers of history and politics. In a real sense, if you're looking for a "road map" to see how America got to where it is, the "legal" history in many respects trumps military, political and economic histories. Here you'll find ll the usual suspects - Magna Charta, the Glorious Revolution of 1688, the Colonial Charters, the American Revolution, Dred Scott, Griswald, Miranda, Roe v. Wade. Expect the next edition to carry Bush v. Gore.

I studied this book in law school. I think the central question of this book is a little deeper than the way the previous reviewer phrased it. The book explores the conflict that occurs when a judgeperceives that the law applying to a case before him is not a just one and will result in injustice if applied in the current case. Does the judge simply apply the law, or find some way around it to allow for a just result? This is an interesting question today, given the debate between "strict construction" of the Constitution and Holmes' popular notion that the Constitution is a "living document" whose interpretation must evolve with the times. The chief example used in this book is the infamous Dred Scott decision, in which a slave who had lived for many years on free soil, sued for his freedom, but was turned down by the Supreme Court on Constitutional grounds -- although presumably the judges knew that this was not a just result.

Star's book attempts to provide the reader with an analysis of Supreme Court decisions that have been key in American histrory.Unfortunetly, his attempt simply turns into a one sided view.Generally speaking (in Star's eyes), any liberal decision made by the Supreme Court is an overt action of "Liberal Judges" making law rather than interpreting law.

Let me first confess that I am the named research aide who assisted Professor Johnson on this book.But what I didn't have anything to do with was his useful organization of the caselaw into topical segments.Not only is this book a useful work for the reasons stated by the other reviewer(s), but if someone wants to know the Court's holdings over time in a number of areas, such as the law of nations or separation of powers, this is a useful book.Professor Johnson organizes the book so that a researcher may use it to glean trends on a particular topic rather than presenting a jumble of topics and leaving it up to the reader to discern the development of the law on a given issue.4-0 out of 5 stars Excellent legal analysis
For those who wish to read a biography of our greatest chief justice, this is not the book to read.For those who are interested in the jurisprudence of C.J. Marshall, this book provides an outstanding introduction.The bookprovides compelling, and accurate, evidence that in addition to JohnMarshall being a great jurist, he was also, and foremost, a founding father-- one of the few who realized the potential for our great nation.Whileit can be successfully argued that at times Marshall expanded the powers ofthe Supreme Court beyond those intended by the authors of the Constitution,the book also provides a compelling argument for the necessity of expandingthose powers. Johnson successfully reasons that, where it not forMarshall's ability to occasionaly read "beyond" the strictguidelines of the Constitution, the role of judicial review (and hence ourconstitutional guarantees) wouldnot exist today. Alexander's book reads like a standard history of property law turned upside down; it is as if the footnotes and text had been reversed. He glorifies obscure, minor, and in many cases simply bizarre theorists ofAmerican property law. Conventional wisdom holds that the winners write thehistory; in this case Alexander not only writes the losers' version ofhistory but argues that they haven't even lost. To understand the thrust ofthe book, consider that although it contains 386 pages of text and another82 pages of endnotes, it presents no substantive discussion of the takingsclause of the Fifth Amendment, despite (or perhaps because of) thatclause's seemingly unambiguous constitutional affirmation of the"property as commodity" view (Richard A. Epstein, Takings:Private Property and the Power of Eminent Domain). John Locke gets only ahandful of passing mentions. By contrast, the views of many obscure andlong-forgotten theorists receive extended discussion.Read more

The basis for questioning the accuracy of Joan of Arc's condemnation trial transcript has not been its date of creation, but the myriad ways in which the trial was rigged.Joan of Arc was a famous political prisoner.Her trial was funded by the government she had warred against and numerous court officials worked under compulsion, some even under death threats.Court clerks later testified under oath that portions of the official transcript were altered.This document did not stand the test of time.A quarter century later the verdict was overturned.

Although this book's marketing material states that it is designed to counter the Hollywood version, the book instead ironically tries to justify the standard Hollywood claim that Bishop Cauchon was a sincere fellow operating under lawful procedures - in contradiction to the many historians, as this book itself admits, who have soundly and consistently debunked that idea. This book does not present any credible evidence to back up its claims, selectively quoting (or misquoting) testimony at the appeal while ignoring both the majority of the witness testimony at the latter trial and glossing over or excusing the well-documented illegalities of the original trial.

I was very impressed with this book, my Uncle was on Trial in this Book, and was pleased with plenty of New Information that I didnt have, I was also impressed about the details of the Times in the Camps, and about the Officers & NCO's etc. I read also the deeds that some things my Uncle did, I am not ashamed on what happened, as I look at it that it all was part of the war, and with this book, I am shown what happened Good & Bad.
