There is not a chapter in this book - indeed, if you omit the index, it would hard to find a five-page stretch - that does not swarm with errors and absurdities.And what is notable is that the errors cannot be classed among those that even the well-informed are liable to make from time to time.They are not mere slips of the pen, they are not minor or superficial, nor of the kind that can simply be skipped over because they play little role in the argument that is being developed.No, they are everywhere manifestations of confusion and ignorance.Posner's merry obliviousness to even the simplest facts about literary interpretation and history is in itself remarkable enough, but what is truly extraordinary is the recklessness with which he parades his ignorance for all to see.1-0 out of 5 stars tiresome and ignorant
The problem is simply that Posner knows very little about literature andliterary history.Thus he is given to fatuous efforts such as hisspeculations on why Shakespeare did not publish his collected plays whenthe fact is that in the early 17th century, playwrights made very littlefrom publishing their writings, and hardly anyone bothered to publish theircollected works.(When Ben Jonson did in 1616, he was widely ridiculed.) Posner's book is riddled with egregious misstatements of this sort, whichwould be comcial to anyone with the most basic education in literaryhistory.In attempting to draw legal conclusions based on faultyinformation of this sort, he only creates further confusion.

Justice Posner is one of the more wondrous polymaths of his generation.Law and Literature, although not the greater of his achievements, is a thoughtful opus, full of illuminating insights.I read his book 6 or 7years ago but I remember how impressed I was by the sharpness of hisanalysis of the legal implications of Kafka's Trial and Melville's BillyBudd.I have been roused to giving my opinion because all the othercommentators are so uniformly negative about the book.Clearly, eitherthey are missing something, or I am wide off the mark.I proposeit's theformer, and recommend "Law and Literature" to anyone who wants toknow how one of the heights of contemporary legal thought tackles many ofthe issues that have occupied anyone who knows the law and enjoysliterature.The fact that Posner doesn't indulge in deconstructionisttwaddle is no reason to abstain. ... Sundby's book takes the reader beyond abstractions about how capital punishment decisions are made, and provides a rare and consistently fascinating account of how two actual juries reach their decisions. The book is filled with insights about the legal and emotional dynamics of the jury room and the courtroom in death penalty cases. It pulls off a couple of very difficult feats. It treats all the jurors interviewed with respect and understanding, and should be equally informative for those with strong feelings for or against the death penalty and for those who are undecided. In addition, it manages to convey quite a bit of valuable information about the death penalty and the criminal justice system in a way that should be accessible and interesting for those with or without a background in the law. In short, a must-read for anyone who wants a better understanding of the American system of capital punishment, or of jury decision-making in general.

This current system as practiced in many states is inherently evil. The system screens out all potential jurors who have the wisdom to understand the fact that the death penalty should never be an option because it is evil and exploits our animal instinct for revenge and vengence. The government that murders one of its own people in revenge for a crime that may have been committed is a government unwilling to set a good example for its own citizens. It is a government that does not understand that this act of killing breeds disrespct for all of the potential goodness, wisdom and compassion that a proper government can bring to add to the quality of life for its citizens. ... I considered buying this when I started law school.However, my school provides law students with free subscriptions to both Westlaw and Lexis online, and the entire school is set up with wireless internet.Therefore, the full version of Black's is easily available to me online any time I'm on campus.A laptop with wireless LAN is probably more important for college students these days than most paper references.

Don't take this book the wrong way. At the time of this review, it cost 29 dollars, a reasonable price when it comes to 1L book costs. It fits into a purse or backpack, if not a pocket. It will serve you well enough in Civpro or Torts in a pinch, until you can get to the Law Library and read a full size Blacks. Do NOT take this book to be an end all be all, it was never meant to be and people who gave this terrible reviews due to its lack of completeness are missing the point. This is a book for when you don't HAVE a full size Black's in front of you, which every 1L should. ... Read more

Relatively up to date (September 11 and law enforcement reactions, USA PATRIOT Act, etc.), and very informative, this textbook provides an excellent survey of the Criminal Justice System.The prose is streamlined, clear, and somewhat non-biased.Minor corrections may need to be made (e.g. the textbook states that the majority of female sexual assault victims do not know their attacker. . .), but these flaws are minor for a textbook of this scope.The book is extensively source documented, making it perfect for anyone interested in expanding their knowledge of the Criminal Justice System.The CD-ROM and online tools are comprehensive, and give the reader/student a more intimate view of the author's vision.

This book gathers together and puts a philosophical/political thoery frame on a range of findings in social science about conformity, information gathering, groupthink, fanaticism, and dissent.The lesson is that a free society needs to encourage, and maybe reward, dissent.If you're familiar with other books the author has published recently (Republic.com, Designing Democracy), the philosophical story and institutional proposals will be familiar.But the survey of the social scientific findings is worth the price of the book.
