That is, to have a general opponent of Marxism in a certain field deal with Marxist views and analysis in such a clear and fair manner. In this case it is Hugh Collins, Fellow of Brasenose College (not particularly known for its radical tendencies) at the time and now a specialist in contract law at the London School of Economics who analyses the possibilities for a Marxist theory of bourgeois law, and he does so with skill and subtlety.

Few books in circulation deal specifically with Marxism and law, probablybecause the former assigns the latter a distinctly subordinate role amongsociety's real determinants. In Marxian thinking, law has neither autonomyin practice - being an extention of class interest - nor autonomy in theory- being hopelessly intertwined with nonlegal structures. Bourgeoistheorists, on the other hand, treat law as possessing the necessary degreeof autonomy that their studies require. Collins hopes to fill the currentgap in scholarship created by Marxism' general neglect of legal theory, andsucceeds admirably. Read more

I should have writen this years ago. I was an administrrative law judge for a stte agency. This can be described as a judicial role in a government (bureucratic) agency.(This has been described as, for the citizen dealing with the government,"where the rubber meets the road".) Most often the bureaucratic pressures overcome the judicial aspect which we brag about to the public. This book can help analyze the issues and alternatives that come up every day. Damaska does not advocate one justice system over another; he simplydemonstrates issues that may arise when pure models are altered. As someoneinvolved in the American legal system, Damaska has provided insight intothe philosophical workings of our legal system and with that insight,changes in legal procedure particularly are better understood.

I consider this book a valuable ressource for cross-disciplinary research on death panelty. It covers a broad range of different perspectives on the topic, which are often neglected in political or even academic debates. The comparative approach makes it even more interesting, since state killings can be shown as being part of "culture" in various societies around the globe. The way people publicly deal with capital punishment actually reveals much of its cultural functions.

An accessible work on capital punishment that goes well beyond the standard moral and cost-benefit arguments. By considering capital punishment in both historical and international contexts and taking an anthropological approach, these essays show the many shades of a discussion that is often reduced to black and white.

Do not buy this book. It's a shame because some of the people who wrote in it. However, the contribution in this book are deeply disappointing, most are either commonplaces or do not bring anything new to the subject.
