Fascinating book tracing the ideological and judicial development of Simon Agranat.Agranat's changes over time mirrored Israel's and reflected the tensions within the developing state of Israel-- democracy and pluralism versus unity and nation-building, progressivism and universality versus particularism, human rights versus "security," etc. The sections on the Eichmann trial and the ongoing "Who is a Jew" controversy are the most powerful sections, while other sections, such as that on the powers of the Attorney General, are a bit dense. Since Israel is still confronting virtually all of the issues and conflicts which Agranat faced as a judge over many decades, this book provides essential historical background and context.

This is an excellent book for the beginner who is interested in becoming an Expert Witness.The maxims are great in that after reading the chapter, you get one point made simply from all that was read.Also, this book gives you tips that you wouldn't normally think of -- even including how to dress for court.

Everyone who has testified in Court has at least one horror story where the attorney made them look foolish or worse.This book prepares you with an understanding of the process, procedures and roles of courts and attorneys.Knowing how to handle those tough situations can increase confidence on the stand and reduce the disenchantment of having been "brow beaten" by an attorney. Everyone, but the most experienced expert witness will find this book invaluable.

This is Brodsky's first book on Expert Witnessing and is now 6+ years old.It remains one of the best primers on what to expect, particularly for the psychologist, when working in a forensic environment.It is easy to read, has great stories, offers good citations, and covers a deceptively wide range of central issues for anyone wanting to be better prepared for work with lawyers and the courts.Each "chapter" is 2-3 pages in length, which makes them easy to read and digest in brief periods as each "chapter" is independent and stands alone well.I have read all three of the books in this "series" by Brodsky and continue to view this one as the best of the three. ... If I recall his New Yorker profile accurately, Posner gets up at 4 a.m. every morning to maintain his extraordinary and excellent output as a public intellectual and judge of the 7th Circuit Court of Appeals. At 145 pages, this volume is perhaps Posner's shortest and--both because it is aimed at a general audience and resulted from a lecture series--one of his most readable.My sense, however, is that it would only appeal to those already steeped in the profession.Not even a law student would find instructive comparisons with Stone, Hand, Friendly, Prosser, or Schaeffer.For those in the profession, however, I recommend this book most highly.It is less valuable for its purported study in reputation than for its profound, if succinct, understanding of Cardozo the man and the insight it provides into the style and logic of some of his best known decisions, Palsgraf and MacPherson chief among them.Posner's original attempt at a quantitative understanding of reputation relies on Cardozo's relative frequency of citation in some Westlaw data bases over the years.It is pseudo-scientific, redolent of Posner's application of economics to an understanding of the law and, while interesting, not very meaningful.The book as a whole, however, is most gratifying.

Judge Posner examines the reasons for Cardozo's reputation and, more important, analyzes the rhetorical methods the judge used in creating some of the most renowned and cited decisions in American law.How and why he crafted the statement of the facts a certain way for one decision, a different way for another; how Cardozo used a lawyer's persuasive skills in reaching results he believed were warranted.Posner also examines the inconsistencies in Cardozo's thinking and opinion-writing.The book presents a portrait of a brilliant, prudent jurist and illuminates his professional shortcomings as well.May have little appeal for the non-lawyer, but for anyone interested in legal writing, the judicial process, and opinion-making, this is a terrific book.

This may be the classic book by Posner. Shorter than most his books--and less encyclopaedic--but also less maiandering. Cardozo: A Study in Reputation stays on track, while revealing a complex sensibility of jurisprudence by Posner and an astounding intuition by Cardozo. In this book we see two great legal minds at work: Cardozo's providing the interpretations that further social welfare and Posner's explaining why these interpretations are so desirable.Read more

My firm took on a civil asset forfeiture case and I received the daunting task of trying to get the case to court.I found Mr. Sibley's book most informative, as it made clear an area of law that is unfamiliar to most. The book includes sample pleadings that I found very helpful.The area ofcivil asset forfeiture is complex, and Mr. Sibley'sbook is a must-readfor anyone who is considering tackling it.

I am a construction lawyer in the Washington, D.C. area and found Judge Goodman's book to be just the thing in giving me a primer on mediation approaches.It is organized extremely well, is easy to read, and gave me lots of help as I prepared for my first mediation.The format of questions and answers is perfect for this subject.The only thing I would like to see is a second volume for advanced mediation, since Judge Goodman has much to offer.

There is a canard that to not know history it to be doomed to repeat it. Usually I have found that most people who read history do so in a manner that distorts it to fit their own views on contemporary issues (Newt Gingrich is a good example of this). This is not necessarily a bad thing but the reader should be self-aware.
