This is an excellent book to get a fast and accurate overview of patents -- what they are, how they are created and defended, etc. Although some books have more detail (e.g., "Patent, Copyright & Trademark: An Intellectual Property Desk Reference") have more detail, this book condenses it into the necessary parts which are excellent for beginning jurists, expert witnesses, or someone contemplating creating a patent.

Clearance and Copyright is a clear language guide to copyright issues as they affect filmmakers and to how to clear copyrighted work so that you can use them in your film.It has sections on clearing the script, any music that can be heard in you film, clips from other movies, sculptures etc which may appear in the background and just about any issue that could come up.At the end of each section Donaldson includes sample contracts which might be used to clear that particular item.

The purpose of the book is to explain the emergence of a more ambitious global intellectual property regime in the form of the TRIPS (Trade Related Intellectual Property Rights) agreement - one of several agreements to emerge from the Uruguay Round of multilateral trade negotiations.The main argument is that TRIPS emerged primarily as a result of good organization and transnational consensus building on the part of a small group of leaders of multinational corporations called the Intellectual Property Committee (IPC), and the coincidence of the perceived interests of that group with key governments such as that of the United States.In the last chapter, Susan Sell shows how these circumstances did not exist for other Uruguay Round agreements and that, as a result, those agreements were weaker.She also argues that the TRIPS agreement represents an overly aggressive interpretation of intellectual property rights to the advantage of multinational corporations and that a political backlash against this is already underway.

Some background on the author is helpful if you are considering purchasing this book as a means of learning the invention process (the following is a summary of the introduction): Prior to inventing several highly successful products, the author was a professional trainer. As a means of service and a way to fulfill his love of training, the author decided to teach an invention course at a local school and sought out a textbook from which to structure the course. No adequate book existed, so he wrote his own based on the insights gained from his experience.

This is particularly impressive when you consider only about 3% of patents earn any money at all for their inventors. I doubt that you will find an inventor anywhere--even Edison--who has capitilized on all of his patents.Bob Dematteis has.I have read his book and have participated in his seminars.His is the most down-to-earth and valuable advice I have ever read in the intellectual property field.Rarely is one individual able to lead the way through the land-mine of steps it takes to turn an idea into a profitable venture.Just in writing a patent application the use of the word "and" instead of "or" can be enough to disqualify a patent's value before it is even issued.

Many people get al excited when they first try to get into the music business only to get shot down by the many intricate twists and turns involving all the legal aspects of running a record label. Mountains of forms and paperwork with no understanding slowly stack up on the producer's desk with no end in site. The situation is a cry for help and that help comes in the form of information, information obtained by reading this very interesting book that details all that is involved with law aspects of this kind.

This book is hella boring, but its definitely a necessity for anyone involved in music. It clears up a lot of questions, and a lot of things you might have never even thought about. Reading this book is a must if you want a grasp on legal concepts. I also suggest "101 Music Business Contracts" from Platinum Millenium.

I am not a lawyer or even a law student, as Corynne McSherry was at the time of the writing of her book, but after seven years (eleven years if you count the adverse effects of this book) of battling against one of the country's most aggressive law firms - and winning - I feel I almost deserve an honorary law degree.I also feel more than qualified to critique this book, considering a large part of the book's thesis tries to invoke the lessons learned in my lawsuit - Pelletier vs. Agouron Pharmaceuticals, Inc.

I reviewed this book for the Journal of Technology Transfer.I thought it would be a simple explaination of legal cases and their implications on university IP.Though it had that at the beginning and end, the real meat of the book is the middle, which explains the university culture better than any book I have ever read.Without understanding that culture, it is hard to know the impact of the cases that McSherry cites.It is often a tough read, but well worth the effort to learn about the history of the copyright system, the role of the gift-economy and commercial ecomomy clash that commercialization issues force on universities as well as the particulars of cases that have the potential to dramatically change how the university functions based on the precedence of several key legal cases.Those whom I have recommended it to, have agreed with me that it is a very valuable book! ... This book presents a clear, concise and convincing argument that subtle changes in U.S. laws starting in 1982 have broken a patent system that was working reasonably well until then. It will be more effective at convincing the average person than most other attempts have been, both because of its style and because it shows that the changes which broke the system shouldn't have been expected to help anyone other than patent lawyers. Their analysis will be useful in helping to avoid the takeover of other agencies by special interests.

Simply put: This is the bible of music licensing. It's not as cheap as the bible and you don't have a prayer of finding it much cheaper than the used versions that someone foolishly gives up on Amazon, but regardless of the price, it's worth every penny. If you want to truly understand the mechanics, logistics, and legalities of music licensing, learn it from the authority who was sorting out licensing issues concerning the Internet and digital distribution over 10 years ago - before it became a "hot" topic.

I discovered this book when I was researching an article "Who owns the rights? Copyright, the law and licensing the show," which was published in the Summer 1999 issue of the Educational Theatre Associationquarterly Teaching Theatre (Volume 10, Number 4) and which is now availableonline (though the reviewer guidelines do not allow me to post the URL, soanyone interested will have to email me at knscott@juno.com for it). Kohnon Music Licensing is a most valuable resource for anyone who either doesmusical theatre, or uses music in theatrical production, since it makesclear aspects of musical licensing that I am sure are as mysterious to manyothers as they were to me before reading this book. In my opinion, everytheatre educator or community theater producer/director should read bothChapter 18, "The Grand Rights Controversy", and Chapter 14,"Synchronization Licenses," before producing another musical (or excerptfrom one) or using any copyright-protected music "dramatically"(a term defined in the book) in the production of any play. AND the authorsmaintain a Website to which readers can bring any question still unclearafter reading the book.

We are constantly bombarded at work and at home by statements pointing out we are now living in the electronic age and the information age. Several times a day we are reminded of this by notices that something is copyrighted or patented. Even at home, when you relax by inserting a video tape into your VCR, the first thing you may see is a stern warning that you may not copy this video tape and if you do, your home may be suddenly visited by FBI agents.
