Dry but the general argument holds up
Any attempt to assemble a detailed picture of society must take into consideration the legal structures that function within that culture. A court system works in two ways: judges influence society through its rulings as often as society at large influences the judicial system. Michael Grossberg's "Governing the Hearth: Law and the Family in Nineteenth-Century America" is a work that combines a comprehensive examination of early American law with aspects of social history in an attempt to arrive at an overarching theme of the development of family law--what would later become "domestic relations" law--and its influence on the larger society. Grossberg relies heavily on legal sources, including appellate court rulings and legal tracts, to construct a three-stage progression of American family law.

This book should be required reading before divorce filings
I wish I had read this book before I got divorced.It could have helped both of us to survive the ordeal.Actually, it might have kept it from becoming an ordeal.Divorce attorneys should be required to read this book and have it in their "lending libraries" or on a "recommended reading list" for their clients.

Mills understands the core issue - the feminists don't
Mills' analysis of domestic abuse (and, by extension, the criminal justice system's response to such abuse) is fatally flawed...
Insult to Injury
I bought it for a college class and found it pretty interesting to read.If you would like to read about the ineffectiveness of the criminal justice system towards domestic violence, this is a great book.

A breath of reality enters 'women's studies'
I don't agree with reviewers who say Ms. Mills 'doesn't get' feminism. The problem with people who spend their careers 'getting' feminism (which judging from some of her jargon may include Mills) is that they tend not to 'get' anything else. I think some of the previous reviewers are likely to have this problem. They can quote us 10 types of patriarchy, but have no suggestions for how women can juggle professional and personal satisfaction, or other thing that actually matter.

ok, I am (yes) a male and I have an interest in gender issues.I happen to think that, just below the surface, our society has serious gender related ills.I have been looking around for years for someone who can attack this problem--approach it, define it, and with the vision to imagine new social possibilities which may offer solutions.This, I think, is needed--not reactionary, experiential nonsense!And out with conservatives and their nineteenth-century-solutions!The best of what our country is is based upon just the kind of careful rationalistic social solutions we find in Dr. Fineman's book.Thomas Jefferson would love this book.I'm not saying she's got the answers, but this is exactly the kind of dialect that is called as the people--no longer the men--of our country look for direction in this transitional era.

Despite the alarming title
Despite the rather alarming-sounding title, this is actually a rather innovative and interesting theoretical work about the meaning of family.The author proposes that a new definition of family be legally adopted toreflect practice and need, rather than traditional notions.She uses themother and child model (this a metaphor for the nurturer and dependantindividuals, whatever their age or gender) rather than our idea now thatthe sexual tie between husband and wife is the tie that binds.So, ratherthan giving tax breaks and inheritance rights and the myriad of legaladvantages to protect a family on the basis of marriage, Martha Finemanproposes that the same advantages be provided by our society to a singlemother with a child, or a man in his 30s taking care of his elderlyparents, or a woman who lives with and supports her developmentallydisabled brother, etc.It is really a completely radical idea, but it isargued persuasively.If she can't convince you, she will at least make youreconsider the assumptions one makes about families and their legal rightsand responsibilities. ... 3rd Edition Vast Improvement
I recently bought the 3rd edition by Diana Brodman Summers.It is a clear, well-organized description of Illinois Divorce Law that includes sample forms for Cook and DuPage counties.The author warns that the law is changing all the time so you need to obtain the most current versions from the office of your Circuit Court.Appendix A lists contact information for all 22 circuit courts and the counties each court serves. Included are web site addresses for the Clerks of Cook and DuPage County.I was able to download the most recent versions as PDF files from the DuPage County Clerks web site.There is no superfluous discussion in the 3rd edition about how to re-enter the dating scene.Even if you ultimately decide to hire an attorney, I think the 3rd edition will educate you well about what your rights are and what you are paying the attorney to do.The author acknowledges the emotional pain of a divorce and advises seeking professional counseling for that, but she sticks to the law.She paints a sympathetic picture of the daily emotional drain on divorce lawyers who hear the horrible things spouses do to each other.I only gave the book 4 stars instead of 5 because I haven't used the book to file my own divorce.After I've gone through the experience with this book to help me, I might write another review.
