This book was a lifesaver when it came to preparing for final exams. A very nice summary that hits all the major topics in Mental Health law. My only complaint is that it hasn't been updated since 97.So although most of the information is still accurate, it doesn't cover any of the more-recent developments in the law. Either way, if your struggling in a course, it's a great tool to have- just be aware that it was published in 1997, but I've looked and this was the best option I could find. ... Read more

I read the Generic Challenge in one evening.It is easy to read, anecdotal and short (100 pages).My favorite portions of the book were Chapter 2 (pharmaceutical patenting strategy) and Chapter 7 (drug life-cycle management).It is hard to believe that so much information and seasoned advice is packed into this little book.

The book is concise, witty, understandable by lay and law people alike, and helpful in understanding the difficulties that innovative drug companies face as well as how generics keep the innovators on their toes.Not designed as a treatise (thankfully), it is helpful for someone who wants a quick and readable overview of patents and drug laws and regulations in the U.S. and elsewhere, and how they affect the incentives to develop new drugs.This is well-suited for people who work at drug companies (whether innovator or generic) and among the professionals that serve those companies, not to mention politicians and others who make or influence policy, or anyone who wants to be informed about the facts and policies that underlie the "generic" debate that plays out in the press.

When someone is hurt during medical treatment it is an understandable reaction to blame the doctor for the harm. However, the great majority of errors which occur in medicine are a simple consequence of conscientious doctors being fallible human beings just like the rest of us. Hospital systems are generally full of design faults which pre-dispose doctors to make mistakes. Blaming doctors for simply being human directs attention away from these design faults, reduces the chance that system improvements will be made, and makes it likely that the same error will repeat itself in the future - thus perpetuating patient harm. Human error cannot be avoided, but patient harm can, through better systems and procedures. Genuinely negligent acts do occur in medicine, but it is important that these are distinguished from the inevitable human errors of clinicians doing their best. This is a distinction which is also required in law to ensure fairness in both the prosecution of negligent doctors and the compensation of harmed patients. This book goes several steps beyond the Institute of Medicine Report ("To Err is Human") in identifying the mechanisms and nature of error within health care and in its detailed discussion of the intricacies of culpability, blame, violation, error, legal fairness, and patient safety. ... "Nutshells" are not just for slackers who blew off the semester and need to cram at the last minute.I've been consistently impressed with the quality of West's Nutshell series.They're excellent study aids for summary, clarification, and getting the key points and big picture.This one is written by two prominent scholars in the field, the senior of whom (Harry Krause at Illinois) is also the lead editor on one of the major casebooks (Krause, Elrod, Garrison, Oldham, Family Law: Cases, Comments, and Questions).Thus this little book is epecially valuable if your class is using that casebook.

This book should be offered to injured workers after their first visit with an attorney who will represent them. It should also be among those on the "required reading" lists in every law school, where attorneys may enter the Workers Compensation practice. The accuracy of descriptions for various categories, (ie. Chronic Pain, etc.), are extraordinary. For the first time in the eight years that I have been dealing with the system, I was able to read what amounted to an all encompassing, yet clear and accurate description of my own dillemma. Truly an excellent book.

Long Goodbye: The Deaths Of Nancy Cruzan by William H. Colby is the in-depth and true story of a judicial trial concerning Nancy Cruzan, a woman who was thrown from her vehicle and suffered horrific injuries. Since that tragic accident, Nancy has remained in a coma for five years, until her family abandoned hope for her revival and requested the removal of Nancy's feeding tube so her life could end peacefully. But the state intervened and denied the family's wishes. Thus began a extended legal battle began over who had the authority and the right to authorize the end of medical intervention with respect to a patient like Nancy. Long Goodbye is a profoundly emotional story of striving to do what one hopes is the right thing, in accordance with the wishes of those who cannot speak for themselves -- and the role of government to intrude into family and medical issues. This is a profoundly important issue that plays out in our hospitals and nursing homes every day. At the crux of the matter is the right to life, the right to die, and who has the final authority over a loved one caught up in a plight similar to Nancy Cruzan and her family.

Despite this book being written by the lawyer who represented the parents of Nancy Cruzan who wanted feeding apparatus to be withdrawn and thus to have Nancy die, this book presents the issues and the struggle fairly and even-handedly.This is shown in a way since after reading it I conclude the U.S Supreme Court's decision was right--in the circumstances shown the family could without monetary loss have permitted their child to not be starved to death.The account of the trial and of the appellate history of the case is absorbing and shows the author is an able lawyer, admirable in representing his clients.I have no hesitancy in saying if it had been my child I would not have gone to the efforts which Nancy's father went to in order to have his child die.But psychologically Nancy's parents wanted the living death to end and their lawyer was right to seek the relief his clients desired.An extraordinary book. ...
