In a matter of color discusses the legalities of slavery in the states of Virginia, New York, South Carolina, Georgia. and Pennsylvania during the colonial period.It reveals how laws contributed to inflicting injustice on millions of Americans, solely on the basis of their color.The State of Virginia, a model of agricultural and economic success, a leader for all the colonies played a major role inthe ultimate institutionaliza�tion of slavery.TheState of Massachusetts after numerous trepidations abolished slavery in 1783.The State ofNew York though not steeped in slavery exuded certain prejudices.Although "Free Blacks" might join the militia and buy real estate, Jews were barred from both.In South arolina, by 1708, less than 20 years after the decision to move from white indentured labor to black labor, black slaves out numbered white inhabitants.In the State of Georgia, the indentured slave system broke down.The need to increase the number of white residents and to assure an adequate and cheap labor supply caused the financing of transportation to Georgia of many free unindentured persons (called charity olonists)and granted them up to fifty aces of land.Another group of emigrants (called adventurers) paid their own passage and received up to 500 acres of land. In the State of Pennsylvania the destruction of slaverywas achieved to a great extent through the private actions of Quakers and Germans freeing their slaves and cajoling their neighbors to act likewise.

I highly recommend this book to anyone who wants to embark on the serious study of racial idealogy here in America, especially as it pertains to the law. Higginbotham's work is widely quoted and referenced in other booksthat I've read. This book forms the bedrock and foundation forunderstanding "how" and "why" it was necessary to forgea wedge between poor whites and blacks, who together, often conspired torunaway from their master, and how black Americans gradually moved from aposition of quasi-servitude to perpetual slavery. The book contains a good analysis of the Plessy v. Ferguson case, decided by the United States Supreme Court, and establishing the doctrine of "separate but equal" that would remain the law of land until overturned in 1954.

Brook Thomas is an English professor, not a legal scholar, and, although much of his work deals with intersections between law and literature, he tends to be more discerning as to literature and social issues than regarding the law. While his Plessy v. Ferguson gives a competent overview of the case and its context, this book is not his strongest work by a long shot. I have had success teaching this book in conjunction with Twain's Pudd'n'head Wilson, and its brief documentary history works well to get students up to speed. But it has a distinctlytext-bookish quality that would make it something of a drag in any but the classroom setting.

This is a comparison of two books with different points of view, one from the heart and one from the head.Tom Wicker's thesis in "Tragic Failure" subtitle "Racial Integration in America" is that racial integration simply has not worked. He would support the William O. Douglas / Thurgood Marshall line of thought that the job of integration will only be complete when most neighborhoods and schools are visibly multi-racial and all races enjoy substantially equal prestige and incomes.He would argue that government, especially the courts, have much more work to do.Read more

Robinson's Wild Beasts and Idle Humours (The Insanity Defense from Antiquity to the Present) sounds and looks more fun than it actually will be for the average reader without a sure grounding in legal, philosophical and psychological theory and history.The author does indeed cover the period from antiquity to the present, as per the sub-title, and provides many interesting ideas along the way, taking a rather conservative approach, but there are also many cases and people just dropped into the book without any explanation on the assumption that the reader will be familiar with all of these legal cases and philosophers from the past two centuries.A grounding in classical and medieval history (with luck I did have that) will help the reader manage the first part of the book.For students of legal history, this book could prove quite interesting and, perhaps, invaluable as the author makes a clever attempt to bring ideas of insanity as far back as the writings of Homer and Hesiod.For this poor soul, the book was a struggle with a few rewards along the way. ... This book discusses the tyranny of big government.Although some of the reviewers argue that tyranny is not a left-right issue, the fact remains that bigger government usually creates greater potential for abuse.Both the so-called Republicans and Democrats are both pretty much statists these days in favor of big government and this book exposes the rampant abuses of the system that has been slowly put into place here in the U.S.

It's difficult to take anything Mr. Roberst writes seriously as he is on all sides of almost every issure depending on his audience.He likes to be "confrontational" which, for him, amounts to attacking politicians and groups from the left for doing one thing and those on the right for doing what he told the left they should do.I guess he believes that makes him "balanced" but it's a lie, he's simply someone who likes to stir the pot regardless whether he actually believes or doesn't believe in the postion he's taking.And that's the trouble, he really doesn't have any beliefs.

With increasing lawlessness, the nefarious tactics of law enforcement are increasingly becoming indistinguishable from those of the "criminal underworld." The Anglo-American common law tradition is losing ground to zealous prosecutors, insensitive regulators, and overly ambitious law enforcement. They are increasingly blinded by ambition and lacking any ethical sense of fairness and integrity as many seldom afford dignity or concern for those they investigate.

This book saved my grade in Constitutional Law.A week before the final I was so confused and lost in the material and I was freaking out!I bought this book as a last hope at saving my grade, and not only did it save my grade, I got one of the best grades in the class!!This is the BEST supplement I have seen yet that explains and ties everything together.I would recommend it a thousand times over to all law students who need a little (or a lot) of help with Constitutional Law.

I bought the Emanuel for property and liked it so much I got this one and the one for substantive criminal law. While I didn't use the crim law one so much (terrific prof), this was absolutely indispensable. We had so much reading in that class that there was no way I could have (a) understood it all on my own or (b) had time to read Tribe or any other hornbook, helpful as they may be.Read more
