The media recently has created the impression that trial litigators often are vultures searching for frivolous complaints from which to extract millions in fees.Corporations seeking to avoid the consequences of policies which make seriously harm the consumer, the employee or the environment join with Republican politicians to reinforce this image. In Defense of Tort Law,Koenig and Rustad superbly demonstrate the reality and the legitimacy of many of the grievances that lead to suits against corporations. However these grievances are seldom adequately addressed because few middle class or working class individuals have the resources to confront multi-billion dollar corporations in long complicated expensive legal battles. The authors do an outstanding job of demonstrating that if punitive damages were eliminated, it would mean the end one of the few mechanism protecting the victims of corporate excess and the power of the corporation would be almost unlimited.

Let's face it--casebooks are usually pretty dull.But this one is different.First, the cases are more modern than anything else out there (sure, there are a few unavoidable classics, like Palsgraf, but most are from the past 20 years) and they cover topics of interest to today's students.Second, the questions at the end of each case are actually USEFUL!Having been involved in legal education myself, I've seen a lot of casebooks, and most of the end-of-case questions are boring and unhelpful at best.Goldberg et al. provide questions that are thought-provoking and add a great deal to one's understanding of the cases, so much so that I would advise readers to skim the questions before reading each case, and then devote some time to answering them afterwards.You'll be surprised how much you benefit from doing so.Read more

Uncertainty is present in virtually every tort litigation. Generally, courts tackle the uncertainty problem by requiring the plaintiff to prove his case by the preponderance of the evidence. However, on numerous occasions tort plaintiffs encounter systematic difficulties in establishing their allegations against defendants. This phenomenon is prevalent in the area of mass torts, which occupies the centre of the tort law agenda in the past three decades. In this area, victims of torts systematically fail to establish their lawsuits against wrongdoers even when it is clear that the latter are responsible for enormous damages. The uncertainty problem is not limited to the mass tort context. In many other contexts, tort and evidence law doctrines also fail to offer satisfactory solutions to that problem. Typically, this failure occurs in cases that involve indeterminate causation, an evidentiary barrier that prevents factual attribution of the litigated damage to the defendant's wrongdoing. Due to this failure, victims of torts are left under-compensated and their wrongdoers under-deterred.

The description by the publisher of a "seminal" book in the field is laughable.Well, if by seminal, he means the one and only case book on the subject.Other wise the book is about as helpful as most legal case books, which is not very.Of course the legal profession has a high thresh hold for worthless and confusing and poorly written text.Just wade into legal scholarship sometime and see if you don't find most of the writing incomprehensible, obtuse, circular, etc.

This book should be mandatory in tort law classes and for legislators.Even if one doesn't agree with the arguments and points made, one cannot discuss tort law intelligently without being able to address Huber's critique.

There are many problems with Huber's book - most stemming from his confusion between capitalism and corporatism.The ever-increasing effectiveness of libability and the "tort cop" in holding anti-capitalist corporations accountable for their actions is a problem for corporatism, which is a good thing for capitalism and society.The "tort cop" effectively polices shoddy actors in the market and even puts them out of business when they are repeatedly negligent in hurting others.

Huber appears to be an attorney by education, if not in practice.He has researched the subject well, and has a dry wit in his comparisons that enliven the reading if the reader has any intellectual inclination.The book does not require heavy concentration but is not for a relaxing fireside session.Covering mainly recent decades where liberal legalists Huber terms "The Founders" significantly altered the face of American law in the area of liability, you will understand why he uses the term "revolution" when you finish this book.The anecdotes and historical cases are fascinating.
