This is perhaps as important a German history as there is. Rather difficult to read without some background in law, nevertheless indispensable to any serious scholar of modern Germany. Wieackerunequivocably indicts positivism (and it's direct ancestor - pandecticism)as a proximate cause of the Nazi debacle. In his view, the extraordinarychanges wrought there, particularly the Industrial Revolution, outstrippeddevelopment of law. The rigidity of the Civil Code of 1900 prevented theintervention of professional jurists in the Weimar crisis, and the Codeitself was too favorable to commercial interests. Essentially, Wieackerargues, German law depended on the auspices of a responsible government tomaintain the balance between big business and the ordinary citizens. Theextirpation of natural law from the legal system shifted the balance towardindustry, and the appearance of an irresponsible legislature led to theextinction of individual rights. He concludes that the Code represented anextreme position in the decades long tug-of-war between the Germanicistsand the Europeanists, and warns that WWII may not have interrupted thenormal swing of the pendulum. ... I would highly recommend this book as a supplement to the case book. It really summed up the material well. It applies many of the cases that appear in Cribbet, Johnson, Findley, and Smith's Casebook on Property, 8th Edition. Even if that's not the casebook you're using, this book is still a really valuable resource as it is simply a summary of the concepts.

Until you read this book, you will be taken advantage of from landlords who know you haven't read the book. I have rented for years and thought if I am a good tenant and pay my rent everything will be wonderful...UNTIL that day!!! By reading this book, I learned there were many times as a renter my rights were violated. I am an excellent tenant with more knowledge. By knowing my rights I have been able to keep situations from getting to the UGLY stage between the tenant and landlord.

Having studied, taught and practiced Federal Indian law for nearly twenty years, I believe that this is the finest examination of the historical roots of legal colonialism in the Americas yet written. Williams is masterful in his research and examination of the Christian, European foundations for the invasion of the Western Hemisphere. Although I disagree with Williams' conclusions about the writings of Franciscus de Victoria, his discussion of the Elizabethan colonization of Ireland and, through extension of the same legal doctrines, native North America, is excellent.

I agree with the reviewer below (or is it above?).I'm almost done with this semester and this has been and will be my toughest course, not because of the material, but because of the way the material is delivered in the casebook.I started with the 1999 edition and was shocked to find that it didnt include a table of cases.A casebook w/o table of cases??? come on!The 2005 edition fixed this problem, but many remain.The problems were clearly listed in the other review, and I concur.

Professor Bernhardt's book is little more than a compilation of cases.There is very little editing and no clarifying information.The comments in between the cases are mostly statutes and some excerpts of other cases- there is very little commentary or even hypotheticals.He includes lots of clever little cartoons, but they are a poor substitute for actual content.The book is basically a cut-and-paste job, and a poor one at that- there are a plethora of typos and grammatical errors.
