With numerous deftly chosen stories of husbands and wives and their contact and experience of the law from the Colonial Era to the present, Hartog describes the slow development of our modern conception of individual rights.This is for the most part the story of wives' evolution from the state of coverture (where the husband was sovereign) to that of an equal partnership of two individuals.Along the way, Hartog develops some striking insights such as his conception of frontier states competing in a "divorce market" for divorcing couples in order to draw potential settlers to their states.Other states, such as California, wrote liberal laws that promised equal treatment for wives as a way to entice women settlers to there -- a kind of rights marketplace.His great achievment is to evoke over the course of U.S. history, the changing expectations and the responsibilities of husbands and wives as to what constitutes a proper marriage.At the same time, he discusses societal ideals embedded in the law, and the pragmatic judges who refashioned those ideals to better reflect the evolving relationships of husbands and wives.He shows that the institution of marriage, ostensibly the most intimate and private and natural of all personal relationships, has close and obtrusive links to conceptions of public governance and individual rights. It is not granted to every historian to discover a trunkful of old documents up in an attic somewhere.The fact that the Illinois-Wabash papers, which fortuitously fell into the capable hands of this particular historian, were located in a basement instead, hardly alters the aura surrounding this discovery, nor does it affect the drama of the issues involved. In sifting through the evidence brought to light by this remarkable find, Lindsay G. Robertson has provided more than a mere tale of "olden days" which might be of interest to a cloistered few: he has produced a revolutionary document which may have far-reaching consequences on the "history" of the future, as well as on our reading of the past.

The story told in Conquest by Law could be the Enron scandal of the 19th Century...the irony is that it is all true and that you wouldn't have imagined it in your wildest dreams. We are used to a context in which the Supreme Court of the United States is the highest court of the land. It is implicit today that when the Supreme Court says what the law "is"...that is it, 'the final word'! However, when this story began there was no such confidence and no history of Supreme Court precedent! The Supreme Court was just another forum for speculation and that is what the protagonists do in Conquest by Law.

I just took the state exam (and passed!!), I have to say this book is writtenin too much of a technical manner and too many details for it to be an easy read. I felt I had to constantly translate paragrapgs into "plain english" to keep me going ...the material is presented in too much of a "dry" manner. Lots of times it was confusing to understand what was said, it was very contradictory. If you are taking the state exam, I highly recommend that you form a study group to "disect" what all the languge is...

Glasser's book is an admirable compilation of the different rules in most of the major countries where reporters would want to operate. It seems to be one of the few books that unifies all the rules for all the different jurisdictions. The book highlights a series of key questions such as the definitions of libel, the abilities of companies to sue on their own behalf or to protect their products, possible restrictions on covering criminal/secret procedures and privacy rules. Drawing on the knowledge of lawyers from the different countries, Glasser organizes their expertise according to these themes.

I studied this book in law school. I think the central question of this book is a little deeper than the way the previous reviewer phrased it. The book explores the conflict that occurs when a judgeperceives that the law applying to a case before him is not a just one and will result in injustice if applied in the current case. Does the judge simply apply the law, or find some way around it to allow for a just result? This is an interesting question today, given the debate between "strict construction" of the Constitution and Holmes' popular notion that the Constitution is a "living document" whose interpretation must evolve with the times. The chief example used in this book is the infamous Dred Scott decision, in which a slave who had lived for many years on free soil, sued for his freedom, but was turned down by the Supreme Court on Constitutional grounds -- although presumably the judges knew that this was not a just result.

Alexander's book reads like a standard history of property law turned upside down; it is as if the footnotes and text had been reversed. He glorifies obscure, minor, and in many cases simply bizarre theorists ofAmerican property law. Conventional wisdom holds that the winners write thehistory; in this case Alexander not only writes the losers' version ofhistory but argues that they haven't even lost. To understand the thrust ofthe book, consider that although it contains 386 pages of text and another82 pages of endnotes, it presents no substantive discussion of the takingsclause of the Fifth Amendment, despite (or perhaps because of) thatclause's seemingly unambiguous constitutional affirmation of the"property as commodity" view (Richard A. Epstein, Takings:Private Property and the Power of Eminent Domain). John Locke gets only ahandful of passing mentions. By contrast, the views of many obscure andlong-forgotten theorists receive extended discussion.Read more

This book was used as the text for a Construction Law case I took in law school.Overall I found the book to be very good.It was clear, concise, well written, and easy to understand.It also brought a pretty wide range of topics into the mix, and provided a fair amount of places to go for additional information (by way of case law).If I had to complain, and for the purposes of this review I will, I would make two comments: 1) There are areas where a little more depth would be nice.Frankly, I don't think the scope of this book really includes in-depth analysis on anything so this might be a non-issue for many folks.I just found that there were a few times (a very few) when I was looking for more information.2. This book does a really nice job incorporating definitions for new terms into the text.However, there are a LOT of new terms and a glossary would have beeen a nice addition to the text.
