No employer should ever accept the "Seven Tests" as the standard for just cause; it is the arbitral equivalent of "reasonable doubt" and much too great a burden.Many public employers have foolishly incorporated this standard into their rules, their training, and even into their labor agreements.If you're in charge, eliminate any reference to it.Most experienced arbitrators will not apply this standard unless it is articulated in the agreement or one party, usually the union, proposes it and the other accedes.For a management representative in collective bargaining and labor arbitration the Seven Tests is at best a know your enemy course.It gets the two stars because it is informative and well written, just wrong.

I can't comment on the materials gathered by the editor, as I have not read the book, but instead happened to notice something about this title when a student was using it in connection with a mid-term.He had to find several cases mentioned in the text, identified only by "U.S. v 'party A'," "U.S. v. 'party B'" etc. and was expected to tell what each case was about.However, the instructor had not furnished the student a list of legal citations for these cases, and the book itself has NO table of cases.Since we found them to be U.S. Supreme Court cases, it was fairly simple to find them using the table of cases in West's Supreme Court Digest, but it would be troublesome if other cases are from scattered jurisdictions.As a matter of convenience for readers, I would strongly recommend that future editions contain a table of cases with complete legal citations to ALL cases referred to, so that readers wanting to find mentioned cases can do so without having to waste time trying to find what the cites are for each one. ... I go to Harvard law school and I have found this book to be helpful in my field of study. Although i also study criminal justice law I have now become interested in environmental and this book has been impressive. This book is a life saver. It was classy and sophisticated. Please go buy this and I hope to see some new challenging faces at Harvard. Thank you for taking the time to read this.

I've used this book in two seated classes and one online course on environmental law. If you want a glorified HAZMAT course or have decided that the way our legal system actually operates doesn't matter, then look elsewhere. This is not a science book (nor should it be). If you want a text that students find easy to read and that provides comprehensive coverage of environmental law and our legal system, this is your book.

I picked this book up out of curiosity.This book far exceeds the fact that Augusta has a "Men-Only" membership policy.This book is very eye opening in large amount of sexual discrimination that is in the corporate world.Martha Burk does extensive research to back up her claims that we still live in a world that accepts and condones discrimination.

Martha Burk writes an extraordinary book about an extraordinary event - how a simple written request of an "old school" golf club to "let women in" turned into a national debate -- a debate that exposed the stubborn underbelly of sexism in the world of golf and in the world of corporate executives, who refused to challenge the "men only" rule at Augusta, the site of America's Master's Tournament.Burk tells the story with enormous credibility, humility, and wit, warning us all, that even in 2005, women better have some "fight" left in us and we might let out a hearty "fore" before we claim we have won the equity battle.A great read - go Martha!

I'm a paralegal, you would think I would know these things.However, I was in a position where I knew I was being wronged, but would have to research and learn an entirely new form of law to make my case.This book had already done that for me.It has simple answers to complex questions; it is organized into a format which allows the reader to make educated decisions. I highly recommend this book whether you are in a situation now, or want to be prepared should you ever find yourself in a situation later.

Even after working in Corporate America for several years as a manager, it wasn't until I started my own business that I started paying attention to employment laws. And then I was amazed at how little attention I had paid to my rights in the workplace when I was an employee! I now realize that I didn't know anything about my privacy rights, or when I was being illegally discriminated against or what to do if I got fired.
