Didn't Find The Keys
This book is a short, but thorough overview of the dynamics of mediation written by someone with a lifetime's experience in the field.While the book's title promises the "keys to conflict resolution" and the subtitle the "proven methods of resolving disputes voluntarily", the work delivers neither substantially.To its credit, the book provides plenty of useful advice and some wonderful inside information on many newsworthy labor conflicts of the past fifty years.Organizational development facilitators and school leaders frequently find themselves in a role equivalent to mediator, so for the would-be facilitator/leader the book is worth the short amount of time it takes to read it. I'm still looking for the keys...

The book is relatively short - 88 pages.The length and organization ofmaterial comprise the beauty of this handy little "how to"reference.Major points are organized in succinct, pithy useful listswhich follow a logical progression for anyone involved in mediationprocesses.Material gets to the heart of the issue rather quickly, whichmakes the book useful as a handy desk reference or useful for a quickbrush-up.In my estimation, Elements of Mediation is a keeper.Read more

Just Cause as the union would have it.
No employer should ever accept the "Seven Tests" as the standard for just cause; it is the arbitral equivalent of "reasonable doubt" and much too great a burden.Many public employers have foolishly incorporated this standard into their rules, their training, and even into their labor agreements.If you're in charge, eliminate any reference to it.Most experienced arbitrators will not apply this standard unless it is articulated in the agreement or one party, usually the union, proposes it and the other accedes.For a management representative in collective bargaining and labor arbitration the Seven Tests is at best a know your enemy course.It gets the two stars because it is informative and well written, just wrong.
