3-0 out of 5 stars Kappeler doesn't like bad outcomes or the police very much
This book was required reading for our department's Sgt's exam.In the aspect of defining current(at the time of publishing, now out of date) civil liability and being informative it was an excellent book. An example, the outlining of the differences between federal claims versus state claims was excellent. Most officers and administrators dont know the difference. His discussion on negligence claims was informative. 4-0 out of 5 stars Eye Opening and Thoroughly Depressing
I can summarize this book in 10 words:5-0 out of 5 stars A critical book for sucessful law officers to read and know.
As a career law officer and University instructor, I have not only used this book to increase my personal knowledge but have chosen it to teach Criminal Justice classes. The information contained in the book givesimportant analysis of the evergrowing concern of lawsuits against thepolice in our litigation prone society. Kappeler provides an easy tounderstand format containing the crucial areas of concern for not onlynewly recruited officers but for veterans as well. The paperback book isvery affordable and should be considered required reading for officersaround the country. If you have not guessed by now... I highly recommendthis book for anyone interested in enhancing or safeguarding their careerin law enforcement. ... Read more

4-0 out of 5 stars Little People vs. Corporate Giant
It all began with a pamphlet entitled "What's Wrong with McDonald's?" that led to the longest trial in British history. 3-0 out of 5 stars God Bless Ben and Friends For Throwing the Tea in the Harbor
Before reading this book, I was under the silly impression that the British legal system, from which ours evolved, was closer to us than it evidently is. It is a reminder that we've come a long way in the development of jurisprudence since Declaring our Independence. 3-0 out of 5 stars Good
The Mcdonalds Corporation has used the threat of litigation to protect both its logos and also its reputation. This is an example in which the threat of legal action came unstuck. Two British enviromentalists had handed out material which it was later found out defamed the McDonalds corporation. Defamation action was threatened unless the enviromentalists recanted. This they refused to do and McDonalds issued a writ suggesting that they had been libeled. Read more

5-0 out of 5 stars EXCELLENT BOOK
This is an excellent book, as are all the Nolo's books.I filed a personal injury case using this book and the other Nolo's book about representing yourself in court and did great. There were very few things the two books did not cover.I disagree with the reviewer that was unhappy with the book. The book does not claim to put you through law school and qualify you as a lawyer by the time you are done reading it....some thinking and effort on your own is required and even then it is not easy to represent yourself in court. But if you dare to enter the world of judges and lawyers...the two Nolo's books are the best bet you have for help.I liked the author (who is a judge) because unlike any judges or lawyers I encountered, he tells it like it is.In one section he mentions judge's lying....what Judge would admit a judge lies?AND BELIEVE ME THEY DO...FREELY AND FREQUENTLY AND THINK NOTHING OF IT!I recommend this book and the other nolo's book highly.

3-0 out of 5 stars Beware of defects!
Because of defects and omissions in this book, the court rejected my request for a default! Boy was I angry! Amazingly the author is a judge!!Specifically in chapter 9, page 3 it says to SKIP item 5. WRONG! Furthermore the author fails to mention that you must file SEPARATE requests for default for EACH defendant. (In my case I sued a small business AND the individual owner)5-0 out of 5 stars This is the book that lawyers DON'T want you to read!
I love it! ...this book has spared my wallet from the reprehensible wrath of money hungry lawyers and legal secretaries. This book explains which forms to fill out, and exactly how to fill them out. It includes examples of already filled out forms. I bought two other books that were of NO help in this department (namely "California Civil Litigation" and "Represent Yourself in Court"). EACH time I had to fill out and file a form this book probably paid for itself 8 times (without a legal secretary) and 25 times (without a lawyer). I successfully represented myself in a breach of contract / money owed dispute. On a more trivial note, the author even correctly forewarns that some court clerks have a tendency to basically treat "pro per" litigants like lower forms of life. Sure enough, I encountered a real smart *ss clerk. But I was prepared for this and dished it right back at her. ... Read more

5-0 out of 5 stars A Keeper Book
This well-written book helps debunk any assumption that the title "Why Lawsuits Are Good For America"may contain an oxymoron.Mr. Bogus describes a common law system that is very recognizable to those of us who practice law in America today. Jurors take their responsibilities very seriously.Jurors are fully capable of finding facts and applying nuanced statements of the law and crafting reasoned verdicts.Keep this book in your library and refer to it when you hear others fretting about whether jurors can handle emotional or big dollar cases.

1-0 out of 5 stars Depressing
The problem with this book is that it doesn't adress important issues facing our legal system today. If for example Ford motor company manufactures a SUV with a faultly shock system that fails and causes the truck to roll over resulting in serious injury or death, clearly we have an open and shut case where Ford is completely liable and you can certainly bet that Ford is going to make sure that problem never happens again. But that's obvious. Anyone who knows little to nothing about the law understands full well that a company who is found to have a faulty product will increase their standards and work feverishly to fix the product in order to prevent future legal action. Carl T. Bogus has taken simple ideas like those and twisted them around to create a driving force for his political agenda, and baseless political agenda no less.
4-0 out of 5 stars Disciplined Democracy
The author's central argument is that product liability lawsuits are an essential vehicle for enabling citizens to impose societal values on powerful corporations. The market can't do this because the profit motive can encourage corporate behavior that unfairly imposes business's costs on the public. Government regulation is often hamstrung by the pressures powerful competing interests bring to bear on the political process. But, combined with important safeguards built into the judicial process, juries bring diverse life experiences, societal mores, and a gut-level sense of fairness to important issues that impact citizens' lives. The common law enables the community to extract information from hard-to reach places and to provide a democratic check on the powerful. I would say the author made his case. ... Read more

5-0 out of 5 stars Thank you, Dr. King for clarity in the toxic mold battlefield. .
As a seasoned Southern Callifornia litigator I found Dr. King's work an immense help and time-saver.I used it as a continual reference through four hard-fought major toxic mold cases, and even provided copies to my clients. While it's not meant to be a citable tertiary reference, it provides clarity to a complex area of the tort law and is very useful in discovery and mock trial preparation. Its medical information is invaluable, since that is where the key discovery and evidentiary battles are fought. It's written from the defense point of view and therefor useful to the plaintiff bar as well. Well done!

3-0 out of 5 stars TOXIC MOLD LITIGATION
This book is skimpy on legal analysis. It discusses seven cases in the eight pages devoted to legal analysis. There is no attempt to write an exposition of tort theories that have been applied, merely a brief of the cases.I exected more legal analysis than the book provides. The strength of the book is discussion of experts.
5-0 out of 5 stars Mold Book is a Real Eye Opener
I am not a lawyer, but I am a concerned homeowner and mother that recently had a mold claim filed.Although Dr. King's book is written for lawyers, I found the information in it to be invaluable in understanding some of the health effects of mold as well as some of the difficulties that my lawyer was having in trying to get our claim resolved.I showed a copy of the book to our attorney, and he bought it right away.He told me that the information in the book really helped him settle our claim favorably. Thanks, Dr. King! ... 1-0 out of 5 stars Very Scary
I skimmed through this book at a friend's place and was absolutely disgusted. I can't believe anyone could read this piece of junk and believe a word the author says. I totally agree with JP Goodwin's appraisal a) if he really did some of the things he says he did he should be in jail and b)that it is part sleazy bio and part propoganda and part hit piece on people he doesn't like.

The picture of the tiger attracted my attention when I bought it. I had no idea PeTA had so many groups that were involved in various crimes. Wow, it sure opened my eyes. Hopefully, the book will give legislators a chance to see what PeTA is all about. Really enjoyed the book and what a life you have lived. I certainly hope that someone sues PeTA someday and protects those people that work with animals every day of their lives. Hope you write another book and expose how PeTA kills animals as I have just read. ... Read more

I am a reporter and Ken's book proved to be a wonderful find.It explains complex legal issues that reporters cover on a daily basis. For any reporter, beginner or experienced, this is perfect addition for you libraryor just good reading if you want a better understanding of the legalsystem.

5-0 out of 5 stars Author's humour makes a breadth of material fun and readable
Required reading for this student of Georgia State University's Executive MBA program ... and I would recommend it to anyone who is or knows an entrepreneur. Ken Menendez does a great job covering a great breadth of factual material and commentary in a conversational, slightly cynical tone.Though written for the businessperson with little exposure to the legal profession, the author manages to keep the experienced reader's interest by offering clever quips and insightful points of advice. It's on my gift list for every small businessperson I know. ...
