If I had to suggest the purchase of this book I would recommend it. There is almost everything in the book about US antitrust. But some warnings are necessary. It's not for students. It's not for lawyers. Maybe scholars and judges can be interested. The author highlights what is not coherent in the body of untistrust legislation. He provides some solution but that solution turns out to be simple: stay put. On that we can debate, but for sure it's a useful check in the bugs of the system. Given the approach I would have given 5 stars if the author had provided some hints or quantitative analysis to the reader on the effects of some of the Supreme Court decisions on lower Courts and on the current management of antitrust law. ... I have enjoyed other writing by Judge Bork.Unfortunately, in "The Antitrust Paradox" Judge Bork misinterprets the word "efficiency" as it applies to antitrust law.U.S. antitrust law was designed to advance Pareto or economic efficiency, not business or productive efficiency.That misunderstanding leads Judge Bork to propose, in essence, the following Carrollian extended syllogism:5-0 out of 5 stars Antitrust or Maximization of Consumer Welfare
In the Antitrust Paradox, Judge Robert H. Bork gives a fascinating, though demanding, review of the most important antitrust issues in the United States. The central, pragmatic thesis of Bork is maximization of consumer welfare (also called economic efficiency) and not the protection of small businesses in addressing any antitrust issue. Unfortunately, the legislative, executive and judiciary branches of power as well as the practicing bar have not always shown consistency in making, interpreting, and applying antitrust rules. The main reason for their shared sub-optimal performance in that area is the too-often absence of a rudimentary understanding of market economics according to Bork. As a practicing marketer and lawyer, I agree with his observation. I treasure Dr. Pat Choates new title (book). It is an easy read and a total epiphany. I thought I totally knew the negative side of so-called free trade and after perusing HOT PROPERTY I realized I knew little. Dr. Choate not only pinned down the significance of intellectual property (new ideas product-wise and the intangible, such as music, books, trademarks, software, methods, processes, and so forth) that stimulates our economy, but also makes clear how Japan in particular has bought off disloyal former D.C. government agents of all descriptions(Congressional staff, legislators, etc.)who have helped Japanese cartels steal the ideas as their own possession.

This book is in large part a polemic against intellectual piracy and in favor of intellectual property protection. Author Pat Choate was third-party candidate Ross Perot's running mate in the 1996 U.S. presidential election. It is no surprise, then, that the book features charged rhetoric and less than scrupulously dispassionate analysis. Nevertheless, it provides an amusing, easy-to-read introduction to the history of intellectual property protection and its role in U.S. industrial development. That history takes some surprising turns. Eli Whitney, famed as the inventor of the cotton gin, went broke trying unsuccessfully to defend his patents. Alexander Graham Bell and Thomas Edison also experienced patent and piracy headaches. Choate recounts these stories with verve and style. He also attempts to be even-handed as when, for example, he draws a parallel between intellectual property violations and the use of traditional knowledge (such as folk medicine) without compensation to the peoples who preserved the traditions. Ultimately, though, Choate focuses more on identifying problems than at proposing solutions. We recommend this book to managers in businesses such as pharmaceuticals and media, which are struggling to preserve their intellectual property rights internationally, as well as to policy-makers and others who are interested in legal and business history.
