I thought I was purchasing an Administrative Law text book. This is not a text book. It is a book of this guy's opinion. For example, he writes that the courts are not well suited to the task of being a watchdog overagencies and says that the members of the Reagan Supreme Court believe thatit is not the proper judicial role for for judges to play an active role inpolicy making.The guy never mentions that the Consitution makes aseparation between the courts and legislature -- he just decides to bashReagan and his appointees.He also states: "...the Depts. ofEducation and energy are still alive and well today and apparently notendangered despite nearly 2 decades of attack by Republicanpresidents...even though the agency's (National Endowment for the Arts)budget is less than a pittance of the whole federal budget, the agency hasbecome the symbolic whipping boy of Speaker Newt Gingrich..."Thisopinion has nothing to do with administrative law, and is completelyunnecessary. I certainly hope anyone who has to read this book for a classwill think for themselves before taking what this guy says as law. This is a well-done book, but one that will be a bit hard for those not at least somewhat familiar with constitutional law to follow.Gerstmann argues that marriage is a "fundamental right" under the constitution, and as such it is illegitimate to refuse to extend this right to same-sex couples.In making this argument he draws interesting analogies to the court's free speach jurisprudence.He tries to show how the more common "gender discrimination" argument doesn't work.I think this part is not 100% convincing, but it is a sophisticated approach.His discussion of the various "slippery slope" objections to gay marriage are also quite good.To my mind the biggest draw-back of this book is that it often makes quite teloscopic reference to other books (including Gerstmann's earlier book) in the place of detailed arguments.This book is not very long as it is, and it probably would have been better servered to give these arguments in more detail rather than just refering to other work as often as it does.This is especially the case for readers who do not have at least some constitutional law background.

I got the first edition of this book because it was the required text for a course I took in UC Berkeley a number of years ago.I have been practicing IP law for about 10 years and I still use it as a quick reference (I also obtained the 2nd Edition).In my opinion this is a very well done book and an useful tool for someone who wants to have the overall picture of a complex issue.

A waste of paper is rather harsh. Yes, this book is not for the paralegal, but I found that it was a great primer for those that may be interested in some of the operation of law -- exactly who I am. I have no real desire to be a paralegal or more, nor do I want to study law in school, but this book is great in that I am presented with basic information in readable form, with no background in law. I give this four stars because it seems to advertise highly technical information, when it really isn't.

In Pierrette Hondagneu-Sotelo's Dom�stica: Immigrant Workers Cleaning and Caring in the Shadow of Affluence, readers explore, along with the researcher, an oft overlooked element of domestic labour in America.In examining this particular manifestation between the haves and have little, Hondagneu-Sotelo has provided a "scholarly" treatment where Ehrenreich's Nickel and Dimed fell short.This is by no means an indictment of Ehrenreich's work, quite the contrary.Ehrenreich's Nickel and Dimed is approachable by the many levels of readers that seek to understand the phenomenon of the working poor and their interaction with affluent Americans (here, I speak specifically of Ehrenreich's chapter two titled "Scrubbing in Maine").However, in Dom�stica, Hondagneu-Sotelo has opted to focus her research on immigrant domestic workers, specifically Mexican and Central American women in Los Angeles.In so doing, her research provides insight into the minds and worlds of both parties who engage in what can easily be termed a "love hate" relationship; one where, out of necessity, both the employer and employees are in need of one another.In addition, Dom�stica serves to highlight some of the struggles of members of America's largest "minority" population (be they documented or otherwise).While Hondagneu-Sotelo relegates her analysis and interviews to women in the Los Angeles area, this reviewer is of the opinion that her research may well be duplicated in other cities with similar populations and yield like outcomes.

The second half of the book is clearly superior to the first half.The lack of hard data from prior to and immediately after the Famine seems to lead the author to some curious and questionable conclusions regarding the economic motivation of the Irish women in America.She repeatedly attributes late marriage and spinsterhood to the "traditional" cultural separation of Irish women and men along with the general lack of character of the Irish male.She fails to examine the profound impact of the Famine on women--watching their families and friends starve to death along with forced immigration--and their determination to prevent this from happening again. I found her theories rather determindly sexist.

Although at first glance Diner's exhaustive study appears to be fraught with the political correctness and feminist biases that plague so many American academics, in reality _Erin's Daughters_ portrays the story of a gallant group that was able to overcome barriers of poverty, ignorance, and disease to succeed in a New World. The Irish women received no help from the government, from existing charities, or from the Catholic Church, but they were still able to reach the promised land of middle-class America due to their focus on economic goals. The women of Ireland carried their cultural values to America with them, playing a key role in the development of the greatest nation on earth. This is a necessary book which does a public service by highlighting the repercussions of poor environmental stewardship. It does not, however, indicate the extent of a broader mystery behind the events in Woburn and Middlesex county itself, respectively.

'Slavery, Law and Politics' is an abridged version of Don Fehrenbacher's 1978 magnum opus 'The Dred Scott Case: Its Significance in American Law and Politics.'While it is a technically challenging book for the average reader of historical jurisprudence, its an indispensible resource for understanding the dynamics of the Supreme Court's decision in the Dred Scott case given the historical milieu just before the Civil War.Fehrenbacher pulls no punches, ripping into the Taney court which issued one of the most shameful decisions in the Court's history.Of interest is the 'scorecard' Fehrenbacher keeps of the different aspects of the decision, clarifying the historical ambiguities of what the court really decided.In all, a complex, gratifying read.
